The client is requested to carefully read the herein contained sale conditions before proceeding with the purchase. Sending the purchase order means that the purchaser is fully aware that he/she agrees with the following Conditions of Sale on the order of purchase.
The purchaser is requested, when the purchase has been finalised online, to print and store these Conditions of Sale and the relevant accepted order.
The products proposed are sold directly by Opificio Serico Fiorentino Srl (from here onwards l’Opificio), registered office in Italy, Corso Duca degli Abruzzi,2 10128 Turin, VAT number 07605650014, Corporation Stock 100.000,00 Euro.
The products can be sold and sent only in the countries listed below link 5.8. Any order received from another country then the one included in the list will be automatically refused from the system. We ask you, in this case, to send an e-mail to the following address: shop@lopificio.it
The purchase contract is available in Italian and English.
1. Our business policy
1.1 The goods displayed on the Site are offered on sale exclusively to “consumers”. In order to this Condition of Sale, Consumer shall mean any individual above the age of consent who is acting for purposes which are outside his or her trade, business or profession.
1.2 Reselling, rental or disposal for any commercial or professional purposes of products purchased from the Site is expressly forbidden.
1.3 To the Consumer it is expressly forbidden to insert a false or fictitious or imaginary name during the procedure of ordering on-line or/and in any other communications. l’Opificio has the right to pursue any violation or abuse in the interests and protection of the consumers.
1.4 Furthermore, accepting this Conditions of Sale, the vendor is exonerate form any responsibility towards the emission of incorrect fiscal documents depending on errors caused by incorrect data supplied during the on-line order registration, as being the client, you are the unique responsible for the correct insertion.
1.5 Considering our business policy, we reserve the right not to process orders received from users who are not "Consumers" and any other order which does not comply with our business policy.
1.6 These Conditions of Sale may be modified at any moment. You are therefore asked to accept only the Terms and Conditions applicable at the time of purchase with each of your orders.
1.7 You are kindly requested to read carefully these Conditions of Sale that can also be viewed and downloaded at any time through the site homepage in order to allow the memorization and the replication of the information by the Customer according to Art.49 of Legislative Decree 206/2005 s.m.i.
2. Contract agreement
2.1 To execute the purchase contract you must fill out the order form following the relevant instructions and selecting “confirm”. Upon confirmation, your order will be submitted, it will be placed and it can not be modified anymore.
2.2 The contract shall be deemed completed when we receive your order form electronically and your data has been verified as correct. Once the contract is completed we shall process your order. The order will be binding only if the purchase process has been completed regularly and in the correct way.
2.3 The order form contains a copy of this Conditions of Sale and a summary of the information on the characteristics of each product and the relevant price (including all applicable fees and taxes), the shipping terms and references to your right of withdrawal and the terms and condition for returning products.
2.4 Although l’Opificio makes every effort to ensure that the pictures displayed on the site represent a faithful reproduction of the original products, including the use of any technical solution to reduce to a minimum the inaccuracy, differences can occur depending on the technical characteristics and the resolution of the computer in use. Therefore, l’Opificio shall not be liable for the eventual inadequacy of the images displayed on the site owning to the above mentioned technical issues.
2.5 Before submitting your purchasing order you are asked to carefully read the Conditions of Sale, to print a copy and to save or reproduce a copy for your own personal use.
2.6 Before submitting the order form, please identify and correct possible input errors.
2.6 The order form will be filed in our data base for the time required to process your order and as provided by law.
2.7 The order may not be placed when it is incomplete, incorrect or when there are not sufficient guarantees of solvency. We shall inform you by e-mail that the contract has not been executed specifying the reasons thereof.
2.8 By submitting the order you recognize and declare to have review all the directions supplied during the purchase process and to fully accept this Conditions of Sale and the Privacy Policy.
3. Product features, prices and availability
3.1 l’Opificio products for sale are only exclusive and top-quality models, the result of the best Italian manufacture. We do not offer irregular products. Anomalous products are not offered for sale. Only vintage products which have been used for exhibition, samples or on movie set, offered for sale in a dedicated may area, may present usury marks. In This latter case, the conditions of the product will be indicated in the description.
3.2 For each product selected the main features of the item are highlighted: photographs of the product, unit price, its colour, its sizes or textile available length.
3.3. You can choose the articles and place them in your Cart, in which product name and picture shall allow the correct viewing of your purchase. Check the correctness of the content of your Shopping Cart before confirming the order completing the purchase form and confirming to have read and accepted the present Conditions of Sale.
3.4 Product prices are expressed on the Site in € (Euro) including all applicable fees and taxes. Delivery costs are excluded and they are indicated in “Shipping and Delivery” section of these Conditions of Sale.
3.5 The total amount shown in the Shopping Cart includes shipping costs, as displayed on the details of the Shopping Cart
3.6 Product prices may be modified or updated. Make sure of the final purchase price before confirm your request.
3.7 All the products come with an identification tag attached with a disposable seal. You should not remove the tag or seal from the purchased products, as they form integral part of it.
3.8 l’Opificio, in case you exercise your right of withdrawal, has the discretion not to accept the return or not to entirely refund the amount of the purchase, in relation to those products which do not have the relative tag, which have been modified in its essential and qualitative features, or which have been damaged.
3.9 All the products are subject to stock limits. The system is updated with the present moment stock, but inconveniences may occasionally occur regarding the availability of certain products. In such circumstances, we will inform you of this fact as soon as possible and in any case within thirty (30) working days starting from the day after you sent the order. In the event that your credit card has already been charged, you will be refunded as soon as possible and in any case within thirty (30) working days from the date in which we receive your purchase order.
3.10 If you are not completely satisfied or the goods do not correspond to the ordered products you have to keep all the documentation and the product and promptly notice us at the e-mail address: shop@lopificio.it
4. Payment
4.1 Payment of the product prices and relevant delivery costs must be made by using credit cards or bank transfer. The credit cards accepted are: Visa and MasterCard. You have to be the holder of a valid credit card at the moment of the order online and the name on the credit card must correspond to the name on the invoice. If these requirements are not satisfied, it won’t be possible to proceed the order.
4.2 We provide the delivery of products only once your credit card data has been verified. The transaction will be charged to your credit card only once the credit card data has been verified; and only after having received the debiting authorization from the credit card issuer and product availability has been verified by us. The Customer’s credit card will be charged only once the order is ready to be processed.
4.3 All payment details will be sent by encrypted protocol to Banca Sella without third parties having any access thereto. Such details will not be used except for performing the purchase procedure or issuing refunds in the case of returns.
4.4.During the process of purchasing, l’Opificio has access to the credit card data ( i.e. credit card number and expire date), which is directly sent to whom who makes the electronic payment through a connection protected by an encrypted protocol. l’Opifcio does not keep the data in any computer file.
4.5 l’Opificio can not be hold responsible, in any case, for any fraudulent or illegal use of the credit card by third parties.
4.5 Bank Transfer: by choosing this payment method, once the order is completed is it necessary to comply with the following procedure:

Bank procedures plan that the transfer made should be validate on beneficiary (Opificio Serico Fiorentino s.r.l.) bank account not before 3/5 days from its execution, therefore to these amount of days should be added the days between the date you place the order and the date you will make the transfer.
After 10 days from the date of order placement without Opificio Serico Fiorentino s.r.l. receiving the bank transfer, l’Opificio will provide to cancel the order.
5. Shipping and delivery
5.1.All products are shipped directly from Italy

5.3 Shipping costs are charged to customers at a forfeit amount of € 6,90 for each order delivered to Italy and of € 15,00 for each order delivered abroad and of € 25,00 for US and Canada.
In case of special events or promotions, shipping costs may change. You can check the amount on your Shopping Cart.
Shipping costs are indicated in your Shopping Cart, with the unit price.
5.4 In accordance with art. 63 of the Consumption Code, any damage to the package/ packaging of the products shall be immediately notified by indicating it in writing on the Courier’s delivery documents. Once the Customer has signed the Courier’s transportation document, the Customer may not oppose objection on the external characteristic of the delivered goods.
In the case of a courier chosen by the customer different from those proposed during the purchase process, the risk of damage or detriment of the products is transferred to You already at the moment of handing the product to the courier, precluding any notification with respect to the external characteristics of the delivery. In this case any notification shall be notified from you to the courier.
5.5 For security reason, at the time of delivery it is necessary a signature by an adult (over 18 years of age). No delivery at post office box will be made.
5.6 All the purchases will be delivered by UPS standard or DHL courier. The orders will be placed and delivered from Monday to Friday, excluding public holidays, bank holidays, shutdown vacations (in August) and Christmas holidays. l’Opificio is not responsible for unpredictable delays, notwithstanding that, except due to force majeure, the products will be delivered within a maximum of thirty (30) working days following the day after the submission of the order.
5.7 We shall make every effort to deliver the ordered products as quickly as possible, and to this end may break up an order into several shipments according to the availability of the items. In this case we will inform you and you will be billed total shipping costs as one single delivery.
5.8 The Risk of lost or damage of the goods, for reasons not depending on us, it is transferred to you only when you or a third party designed by you and different from the courier, gets materially the good.
5.9 At the time of delivery the Customer, or a person in charge, shall be present in order to verify that the packaging and the product are not damaged.
Any damage in the packaging and/or in the products or any discrepancy between the number of the boxes actually delivered and the number of the boxes indicated on the delivery note, shall be immediately notified by indicating it in writing on the Courier’s delivery documents. Once the Customer has signed the Courier’s transportation document, the Customer may not oppose objection on the external characteristic of the delivered goods.
5.10 Currently the products can be ordered exclusively from European Union state members, United States of America and Canada.
6. Right of withdrawal, returns and refunds
6.1. You may cancel your contract without any penalty and without specify any reason, within fourteen (14) days, starting from the day you or a third party, different form the courier and selected by you, acquires the material possess of the goods.
If you withdraw from the contract, you will be refund of all the payments you made to us, including shipping costs (except for additional costs derived from your possible choice of a kind of shipping different from the one less expensive kind of standard shipping we offer), without undue delay and, in any case, by and no later than 14 days from the day we've been informed about your decision to recede from the contract. The refund could be put on hold beyond the 14 days if you prove that the goods have been sent back or if we receive them, depending on which situation occurs earlier. In case of a multiple batches shipping, the effective time period (14 days)will be considered starting from the delivery date of the last batch.

of your decision to withdraw from this contract through an explicit declaration (e.g. submitting the Withdrawal Form, sending us a letter via post, fax or email).
6.2.1 To cancel an order you can use the Return Form present in your page My Orders in the section My Profile or any other explicit declaration to shop@lopificio.it.
We shall confirm you via email that we received your request of Return.
If the product is in the phase of being delivered, the order cannot be cancelled: you should return the product once you received it.
6.2.2 Returns
In order to withdraw from the contract after receiving the products, you should fill in the Return Form (enclosed pdf file) and return us the products you received, consigning them to the courier for the delivery without undue delay and in any case within 14 days starting from the day in which you inform us about your decision to withdraw from this contract.
You can return the purchased product/s by informing us within 14 working days starting from the day of delivery. The return policy, regulated by these conditions of sale, does not apply to those products that are customised and/or manufactured on a single order basis.
In order to proceed with the return, you can fill in online and send us the Return Form or any other kind of explicit declaration at shop@lopificio.it or to l’Opificio – Opificio Serico Fiorentino srl, Via Martiri della Libertà, 42 – 10131 Torino. In case you choose to fill in and directly send us online the Return Form, we shall confirm you via email that we received your request of return. In case you choose, however, to send another notice of return, the burden of proving the proper and timely exercise of the right of withdrawal, will weigh on you.
Terms are being respected if you return the products before the due period of 14 days.
6.3 You shall only be liable for any diminished value of the goods resulting from the handling other than what is necessary to ascertain the nature and functioning of the goods.
6.4 Effects of withdrawal
If you withdraw from this contract, you will be refunded the whole amount you paid us, shipping fees included (except additional costs deriving from your eventual choice of a different kind of delivery from the standard one we offer), without undue delay and in any case within 14 days starting from the day in which you inform us about your decision to withdraw from this contract. You will not incur any fees as a result of such refund.
6.5 If the courier was selected by you and therefore not among the ones proposed during the purchase process, all the damage risks will be transfer to you already during the delivery to the shipper phase, preventing any complaint about the external characteristics of the good delivered. In this case, each complaint should be made by you directly to the shipper. The only costs you will be charged of are the ones of return of the purchased goods (€ 6.90 Italy, € 15.00 abroad, € 25.00 USA), unless we have specifically exempted you in writing by such expenses when purchasing the product, and to the additional condition that you use the courier we specified on the Return Form. Such form will be included in the package. If you decide to use a different way of shipping from the one we suggest, the refund shall be suspended until receipt of the goods or until the system demonstration by the consumer of having sent back the goods.
6.6 If you decide to use the courier we specified in the Return Form, you shall not pay in first person the shipping fees. Shipping fees will be directly paid by us on your behalf, releasing you in such way from any payment obligation with the courier. l’Opificio, to pay the return, will deduct from your refund a forfeit amount equal to the standard shipping fees of purchased products. Furthermore, from the moment you will return the product to the courier we specified on the Return Form, we will relieve you from any duties in case of loss or damage of the product during transport.
6.7 If you decide to use a different way of shipping from the one we specified on Return Form, you shall pay shipping fees in first person for the return of the products. In such case, you will be refunded also a forfeit amount equal to the standard shipping fees of purchased products, whereas you will not be refunded potential additional expenses you had for choosing a different and/or faster shipping than the standard one. In this case you will not be relieved from duties in case of loss or damage of the product during transport, due to a negligent choice of the courier and/or the way of transport.
6.8 The right of withdrawal – besides the compliance with terms and conditions described in 6.1, 6.2, 6.3 and 6.4- is intended correctly exercised when are respected also all the following conditions:
a) the Return Form directly transmitted online via shop.lopificio.com or different explicit declaration stating your willing to terminate the contract should be correctly filled in and transmitted to us within fourteen (14) days from the reception of the products;
b) the products should be returned complete and should not have been used or washed;
c) the identification tag should still be attached to the products as integral part of the goods;
d) the products should be returned with their original packaging;
e) the products should be returned to the courier within fourteen (14) days, starting from the day you transmit us your decision to terminate the contract;
f) the products should not be damaged.
6.9 If the right of withdrawal will be exercised following the terms and conditions here described, we will provide to refund you the potential amount already cashed in for the purchasing of the products, according to the terms and conditions provided.
6.10 We will refund you as soon as possible, and in any case, within fourteen (14) days starting from the day after we received your return request. Once verified terms and conditions of your request according to the above conditions, we will provide you with the refund.
7. Terms and Conditions of Refund Policy
7.1 After the return of goods, we will provide to the necessary inspection relating to term and conditions specified in paragraph 6. If the verification is positively concluded, we will send you via email the relative confirmation of the acceptance of the goods as returned. In case the inspection will not be positively concluded, we will communicate you via email the noticed existence of a decrease in value of the returned goods, resulting from your lack of compliance with the conditions described in paragraph 6.7. At the same time, we will communicate you the amount that will be deducted to the amount you paid for the returned goods; provided that, as an alternative, you can reacquire –at your expenses- the goods in the conditions they have been returned.
7.2 Whichever payment method you used, the refund, entire or partial, will be done in the shortest time possible within fourteen 14 days starting from the day we received your request to exercise your right of withdrawal, only after having verified the correct execution of your right of withdrawal and the conditions of the returned goods.
7.3 We will refund you by the same payment method you used in the purchase, unless you expressly asked us to use a different payment method, and provided that you should not pay a further amount as a consequence to the refund. If the addressee of the goods specified when placing the order does not correspond to who made the payment for its purchase, the refund, in case of right of withdrawal’s exercise, will be made in any case to who made the payment.
7.4 The value date of the refund is the same of the charge, so as you will not have any loss in term of bank interests.
7.5 We designate since now UPS (http://www.ups.com/) as courier for returning the goods. Through UPS, using the pre-printed sticker provided in the parcel containing the products, you can return the goods without paying in first person the necessary fees. According to the terms and conditions related to the exercise of the right of withdrawal, this way allows us the direct payment on your behalf of the return shipping fees, relieving you from any payment duties with the courier. Furthermore, such method permits to track the exact location of the package at every moment of the shipping process, relieving you from any duties in case of loss or damage of the goods during the transport.
7.6 As stated before in paragraph 6.7, if you decide to return the goods via a different courier from the one we specified, shipping fees and duties for potential loss or damage of the goods, will be on your charge. Furthermore, if you decide to use a different way of shipping from the one we suggest, the refund shall be suspended until receipt of the goods or until the system demonstration by the consumer of having sent back the goods.
8. Legal Compliance Warranty
8.1 All products marketed through our site have the legal compliance warranty set out in Articles 128 and Of the Consumption Code, applicable, in any case, only to the consumer.
8.2 Under the law we have the obligation to deliver goods in accordance with the sales contract.
8.3 We will respond to you for any defects in conformity of the purchased items, which exist at the time of delivery of the aforementioned items, which occur within 2 years of delivery.
8.4 To qualify for the above warranty, you must report the defect of compliance within two months of your discovery, under penalty of loss to

Such complaint must contain a thorough and complete description of the defects / defects that have been contested.
8.5 We will meet your communication, giving you instructions for shipping the defective item, which will be at our expense.
8.6 We will have the right to request you to attach to the defective item for which you intend to claim the purchase invoice or other document certifying the completion date of the sale.
8.7 If operating, the Legal Compliance Guarantee entitles you to obtain free repair or replacement of your choice, unless the remedy required is objectively impossible or excessive overpayment to the other available.
8.8 You will have the right to request, at your option, a reasonable price reduction or termination of the sales contract only if the repair or replacement is impossible or excessively costly, i.e. repair or replacement has not occurred in the right terms or repairing or replacing caused you major disadvantages.
8.9 Under no circumstances a minor compliance defect shall be entitled to termination of the contract.
8.10 Except for defects in conformity and, as a consequence, any defects or accidental damages caused by accidental or consequential damages or damages resulting from the use of products which do not conform to the intended use or normal wear are excluded from the legal warranty.
9. Applicable law
9.1 The terms of sale are governed by Italian law and in particular by Legislative Decree 6 September 2005 n. 206, on the Consumption Code, with specific reference to the rules on distance contracts and Legislative Decree 9thApril 2003 no. 70 on certain aspects of electronic commerce.

10. Modifications and Updating
l’Opificio reserves the right at any moment to modify this Conditions of Sale and the Privacy Policy. These amendments shall be effective only in relation to purchase orders submitted after the date of the publication on the website of the modification or amendments.
